David R. Pheils, Jr. has a wide business, construction and computer experience and was a licensed commercial pilot before graduating from the University of Toledo School of Law in March 1974 at 40 years of age. Since then, he has become a certified peace officer, police detective and firearms instructor. He is admitted to practice law before the U.S. and Ohio Supreme Courts and Court of Appeals plus federal and state trial courts. His affiliations include: the American and Ohio Bar Associations, the American Trial Lawyers Association, the Ohio Academy of Trial Lawyers and the Society of Automotive Engineers. He has extensive civil trial experience and has successfully established new law by cases appealed to the Ohio Supreme Court.

In addition to obtaining numerous reversals of both State trial and appellate courts and Federal District courts, he has obtained writs from the Ohio Supreme Court directing Ohio trial and appellate courts to stop doing, or proceed to do something, as demanded by him on behalf of his clients.

Mr. Pheils has established new law in Ohio as to the duties owed by controlling shareholders to minority shareholders in a close corporation, Crosby v. Beam (1989) 47 Ohio St.3d 105; and as to the allowance of personal injury damages for inability to perform usual functions, more commonly called “loss of life’s enjoyment,” Fantozzi v. Sandusky Cement Prod. Co.(1991) 62 Ohio St.3d 6.

He has obtained millions of dollars for his clients who suffered injuries and the deaths of loved ones from the perpetrators of such injuries. He has a reputation for aggressive pursuit of his clients’ rights and refusal to give up as long as there is any viable claim to pursue.

He has recovered settlements and verdicts for as much as 2.2. Million and as little as a few thousand, but pursued them all with the same fervor and dedication to justice for his clients. You are entitled to nothing less and should accept nothing less.

Marshall (Marty) D. Wisniewski graduated from the University of Toledo School of Law in 1980. Since 1981, he has been admitted to practice before the U.S. District Court, the Courts of Appeal, the Ohio Supreme Court, and State Trial Courts. He has extensive experience in media and entertainment law, intellectual property matters, personal injury, wrongful death, malpractice, discrimination, transportation, business, corporate and contract issues. His affiliations include the American and Ohio Bar Associations, the American Trial Lawyers Association, and the Ohio Academy of Trial Lawyers. He has successfully represented Plaintiffs seriously injured, or killed as a result of semi-truck crashes, construction site, and auto/bus accidents, nursing home abuse and neglect, and medical and psychological malpractice.

In one case, a semi-truck crossed the centerline and hit a married couple head-on. The husband, an autoworker, was killed and the wife was permanently injured. The jury awarded the wife $1.5 million for her husband’s death which the Defendant immediately paid and settled the wife’s personal injury claim. At a highway construction site, the death of a construction worker was caused by the failure to take proper safety precautions. That claim was also settled for more than a million dollars. His family’s financial future was then secure. Pheils & Wisniewski have successfully prosecuted nursing homes for abusing and neglecting seniors. They were dehydrated, malnourished, and developed huge pressure sores – in one case so bad – the Plaintiff had to have her leg amputated below the knee. Those cases were also settled for more than a million dollars.

Mr. Wisniewski has also sued doctors, hospitals, and psychologists for malpractice. Several clients bled to death in the emergency rooms of local hospitals. In another case, the client’s therapist sexually abused them. All Defendants were aggressively pursued, and justice was achieved for each client.

Young children also make up a large part of Marshall’s personal injury clientele. A school child was run over by a school bus in the early morning while walking to school. A teen suffered serious internal injuries when the driver of her car lost control and crashed into a tree. Mr. Wisniewski took special care to see they all received large and just settlements, which were then approved by the Probate Court.

Mr. Wisniewski also represents authors, media performers and other talent regarding their intellectual property rights. He negotiated a publishing agreement, and then successfully sued the publisher for breaching that contract.

Marshall’s experience in business and corporate legal matters is also diverse and multifaceted. He has represented large and small businesses including trucking and construction interests, commercial landlords and tenants, apartment owners and condominium associations. He has obtained large judgments in breach of contract and collection cases. As well, Marshall has negotiated and drafted joint venture, partnership, lease and independent contractor agreements. He has defended large corporations in wage and hour investigations by the Department of Labor, and in sexual harassment cases.

He is also currently representing radio and TV station owners. He is general counsel for Corporate Media Consultants Group, Power Television International and NOW-TV. He also represents TV stations Fox 23 and Channel 15 in St. Croix, U.S. Virgin Islands. He is experienced in media property sales and acquisitions, along with TV and radio show production syndication and distribution contracts.

He is also proud of his Eagle Scout rank, and is very active as a committee chairperson in his community’s local Scout Troup.
